Welcome to the Osgoode Law Library's guide to Construction Law.

This guide will introduce you to basic resources to assist you in conducting research in Canadian and International Construction Law. 

What is Construction Law?  

Construction Law is defined as "the law that applies to and in respect of the undertaking of construction and engineering projects." (Bailey, 2016, p.4)

Construction Law is considered to be highly complex as it requires familiarity and knowledge of the following areas of law:

  • Procurement (Bidding, Tendering; Government and Municipal)
  • Contract (Drafting & Negotiation)
  • Property & Real Estate (e.g., Agreement of Purchase & Sale; Land Ownership)
  • Labour and Employment (e.g., OSHA, Human Rights)
  • Environmental (e.g.,Waste management, Contaminated land & Land inspections)

  • Finance (e.g., Loans; Prompt Payment legislation)
  • Tax (Bankruptcy & Insolvency)
